2. Patent granting time
- The examination is carried out after the application is submitted to the National Office of Intellectual Property (NOIP). Patent examination is carried out in two stages, formal examination and substantive examination.
- A formal examination is conducted to determine whether the submitted application meets the formality requirements. According to the law, the time limit for formal examination is 01 month from the date the application is submitted to the NOIP.
- An invention registration application is published by the NOIP in the Industrial Property Official Gazette within the 19th month from the date of application or from the priority date for priority applications.
- Substantive examination is conducted to determine whether the application meets the requirements for patent protection. According to the law, the time limit for substantive examination of a patent application is 18 months from the date of the request for substantive examination (if the request is filed after the date of publication of the application) or from the date of publication of the application (if the request for substantive examination is submitted before the date of publication of the application).
- The results of substantive examination will be notified to the applicant by NOIP.
3. Term of validity
- An invention patent is valid for 20 years from the date of application. The Utility Solutions patent is valid for 10 years from the date of application and is non-renewable.
- In order to maintain the validity of the patent, the author of the Invention/ Utility Solution is required to pay the annual maintenance fee for the patent within 06 months before the validity of the patent expires (from the date of granting the patent).
4. Fees - The fee for registration of an invention/utility solution depends on the number of objects to be protected in an application, the number of pages of the description, the number of drawings (if any) and will be charged specifically for each application.
