PLANT VARIETY RIGHTS
► When organizations and individuals need to protect their rights to new plant varieties, they can authorize an intellectual property representative to carry out the procedures.
Implementation steps:
- Step 1: Receive application for new plant variety protection
- Step 2: Verify the application form and notify, reject or accept the Application. If the application is valid, request the registrant to send the seed sample to the testing establishment
- Step 3: Publish the valid application in a specialized journal on plant varieties
- Step 4: Verify the content of the protection registration application (including assessment of novelty name of the plant variety testing and evaluation of technical test results for plant varieties)
- Step 5: Grant or refuse to grant a plant variety protection certificate and record it in the National Register of protected plant varieties if granted.
⇒ Results received: Certificate of registration of new plant varieties.
Documents include:
1. Registration declaration according to the prescribed form
2. Photograph, technical declaration according to the prescribed form
3. Power of attorney if the application is filed through a representative
4. Documents proving the right to register, if the registrant is the person to whom the right to register is transferred
5. Documents proving the right of priority, if the application has a claim for priority right
6. Proof of payment of fees and charges
